1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Bookie service operated by Lazy Brain Ltd ("Bookie," "we," "us," or "our"), available at bookie.press. By accessing or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of Service

Bookie provides a voice-based interview service that produces written book manuscripts from your spoken words. The service includes AI-assisted interviewing, transcription, chapter drafting, editing, and delivery of a finished digital book in PDF or Word format.

3. Eligibility

You must be at least 18 years old to use Bookie. By using the service, you represent and warrant that you have the legal capacity to enter into these Terms.

4. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@bookie.press if you suspect unauthorized access.

5. Intellectual Property and Content Ownership

You retain full ownership and copyright of all content you provide to Bookie, including voice recordings, text, photographs, and notes ("Your Content"). You also retain full ownership and copyright of the finished book produced from Your Content. Bookie claims no intellectual property rights over Your Content or your finished book.

You grant Bookie a limited, non-exclusive license to use Your Content solely for the purpose of producing your book and operating the service. This license terminates when you delete your account or request data deletion.

The Bookie name, logo, and service design are the property of Lazy Brain Ltd. You may not use our trademarks without prior written permission.

6. Pricing and Payment

Chapter one is provided free of charge with no payment card required. Current pricing for full books is displayed on the pricing page. All prices are in US dollars.

Payments are processed securely by Stripe, Inc. We do not store your payment card details. By making a purchase, you authorize us to charge the applicable fee to your chosen payment method.

Gift purchases are non-refundable once the gift has been claimed by the recipient. For unclaimed gifts, contact us for a refund.

7. Refunds

If you are unsatisfied with your book, contact us within 30 days of delivery. We will work with you to revise the book to your satisfaction. If we cannot resolve the issue, we will provide a full refund. Refunds are issued to the original payment method.

8. Acceptable Use

You agree not to use Bookie to:

• Produce content that is defamatory, fraudulent, obscene, or that violates the rights of any third party
• Impersonate another person or misrepresent your identity
• Upload malicious code, interfere with the service, or attempt to gain unauthorized access
• Use the service for any illegal purpose

We reserve the right to suspend or terminate accounts that violate these terms.

9. AI Disclosure

Bookie uses artificial intelligence to conduct interviews, transcribe speech, and draft book chapters. All AI-generated content is derived from your spoken words and provided materials. Your Content is never used to train public AI models. You are the author; the AI is the tool.

10. Privacy

Your data is handled as described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that the results will meet your specific expectations.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Lazy Brain Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total aggregate liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Lazy Brain Ltd, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

14. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "last updated" date. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

15. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the service ceases. You may request deletion of all your data at any time.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
